I-94 AUCTION BLOCK, LLC TERMS & CONDITIONS:

I hereby agree that I have read, and will abide by the Terms and Conditions outlined hereafter as a registered bidder.

  1. Bidder agrees the following terms and conditions are a legal binding contract between Bidder/Buyer and I-94 Auction Block, LLC.
  • It is the Bidder’s responsibility to ensure all information on the registration is full and complete, and remains valid and current over time. I-94 Auction Block, LLC relies on this information to complete sale, payment and schedule pick up.
  • I-94 Auction Block is not responsible for any accidents, damage, errors or theft.
  • SPECIAL TERMS: Special terms may apply in addition to these terms. I-94 Auction Block, LLC will make every attempt to clearly state those Special Terms in an Information Block at the beginning of the auction catalog.
  • TECHNICAL ISSUES: I-94 Auction Block, LLC is not responsible for any technical issues the Bidder may experience and will not be held liable.
    • If, for whatever reason there is a site malfunction, or loss of service during the auction, I-94 Auction Block reserves the right to remedy the situation in whichever way best represents the seller, including cancelling existing bids.
  1. ITEM DESCRIPTION: It is the Buyers’ responsibility to verify each items’ description with each photo as multiple items may inadvertently be photographed.
  2. SALE: Some items may be subject to a satisfactory price as determined by the Seller. In these cases, if this price is not met, the items may not sell. Seller can accept or reject any and all offers and prices. Even if the Bidder is notified at auction close of highest bidder, the property is not sold until the seller confirms and approves the bids, unless the auction is stated as “absolute”.
  3. AUCTION CONDUCT: Conduct and increments of bidding are at the discretion of the auctioneer. All decisions of I-94 Auction Block, LLC are final. Each Buyer is responsible for conducting their own review of each item prior to placing a bid.
  • Items used to display or contain items in photographs may or may not be included in the auction sale; it is the Buyers responsibility to read the item description in full to determine whether these items are included in the sale price. Any questions can be fielded by our office and contact information can be found on our website and bidding platforms. We will do our best to return all inquiries and messages within 24-48 business hours. We strongly encourage bidders to preview items on preview days to ensure accurate descriptions.
  • All bids are final, no bids will be removed once placed.
  • I-94 Auction Block, LLC reserves the right to edit or remove items from the auction, split or combine lots, and control minimum bids or reserve prices. I-94 Auction Block, LLC may at any time reschedule, cancel, suspend or extend an item, or auction event.
  • AUCTION CLOSING: Closing times will be posted on the information page of the website.
  • EXTENDED BIDDING: This feature is used within the last five minutes of the auction. Lots that go into extended bidding will continue extending upon each bid in 2 minute increments. It will stop extending once no bid has been placed for the time frame of the 2 minute increment. This timeframe is subject to change at any time, at discretion of auctioneer per auction settings.
  • MAX BID: This feature is used when a bidder places a bid higher than the next preset bid increment. Bidders can place a MAX BID by entering the dollar amount of your highest bid. The Computer will then continue to hold your MAX BID as bids are placed until someone else out-bids your amount.
  • Bids are placed in the order they are received.
  • You may request OUTBID NOTIFICATIONS when registering for your account.
  • PAYMENT: A credit card is required for registration but is not our only form for payment. Credit card payment for purchases up to $2,500 is accepted. Purchases more than $2,500 must be paid via cashier’s check, bank wire or cash.
  • FINAL SALE: Bidder agrees all items listed are sold as is with no warranty, and are not subject to return.
  • BUYERS PREMIUM: 12% will be added to the bid price for Buyer’s Premium. Example: Bid Price of $100 plus 12% Buyer's Premium would come to a sub-total of $112, PLUS applicable sales tax. All auctions are not contingent on, or subject to financing, of any kind, as agreed to by bidders at registration prior to bidding.
  • TAXES: All sales are subject to county sales taxes at the current rate. Tax exemptions (MN-ST3 Form) may be accepted with certificate as provided by Buyer, and MUST be provided by 2PM on the day of auction close to avoid paying tax.
  • Payment is due at the conclusion of the auction.
  • Payment can be made by cash on site, wire transfer, ACH or Credit Card (there will be a 4% processing fee associated with credit or debit card payments). Only local business checks will be accepted unless otherwise approved prior to the sale by auctioneer. All returned checks will result in a $30 fee. If charges are declined by the credit card processor, a non-sufficient funds charge of $30 will also be charged each time processing is denied. In the event charges are declined, Buyer will be notified and given until close of business the following day to remedy payment method, or item will not be released to Buyer.
  • Any items not settled by end of pick up date as listed per auction event, they are considered in default and will result in ownership of the item back to the original seller. Full payment is required before receiving a receipt.
  • Buyer agrees not to initiate any credit card charge backs.
  • PICK UP: Buyers need to pick up purchases at selected pickup time. If you are unable to pick up during designated pick up time, you may send a representative with prior approval and confirmation of I-94 Auction Block, LLC to pick up your items, or you may forfeit them. Please send a form of ID, along with invoice with your representative if you so chose to send one in your absence.
  • I-94 Auction Block, LLC may in some cases assist with loading and lifting, but is not required to do so. Be prepared to plan for your own loading of auction purchases. Auctioneer reserves the right to refuse load out and pick up of any items that may cause any damages or risk anyone’s safety at the loading site. Auctioneer is not responsible for any damage caused during the loading process.

NOTICE: If for any reason, payment is not received, or decent conduct is not exhibited by Buyer, I-94 Auction Block, LLC reserves the right to suspend Bidder’s profile on our platform(s). Reinstatement of bidding privileges will be handled on a case-by-case bases and are not guaranteed.
